INSTAGRAM COMPETITION RULES

By taking part in the Instagram competition, you declare that you accept these rules.

  1. Organisation - The association organising this campaign is the Société des amis de Marcel Proust et des amis de Combray ("SAMP"), whose head office is located at 4 rue du Dr Proust, 28120 Illiers-Combray, France, and whose RNA number is W281004165.

  2. Dates - SAMP is organising a free game with no obligation to buy, hereinafter referred to as "Photograph Auntie Léonie's house" from 18/05/2024 to 30/09/2024 at 23:59 Paris time (hereinafter referred to as the "Game"). The winners will be selected between 1 and 29 October 2024. The winners will be announced on 31 October 2024 on SAMP's Instagram account and on its website www.amisdeproust.fr.

  3. Participants - This free competition with no obligation to purchase is open exclusively to anyone who uses Instagram.

Persons who do not meet the conditions set out in these rules, as well as members of the staff of the SAMP, members of the jury and any person who has participated directly or indirectly in the design, production or management of the Contest, as well as their spouse and members of their families: direct ascendants and descendants or other relatives, whether or not living under their roof, are excluded from the Contest.

The SAMP reserves the right to ask any participant to provide proof of the conditions set out above. Any person who does not meet these conditions or refuses to provide proof will be excluded from the competition and, if they win, will not be entitled to their prize.

Participation in the Contest implies full acceptance of these rules, as well as the applicable French laws and regulations.

For minors wishing to take part, the parents or legal guardian declare, by taking part in the competition, that they approve the rules. The SAMP reserves the right, when designating the winner(s), to have these rules approved by a parent or legal guardian if a minor has been chosen among the winner(s).

  1. How to enter - Participants must follow the @amisdeproust account on Instagram and post one or more photos of La Maison de tante Léonie on Instagram, mentioning @amisdeproust and the hashtag #ConcoursPhotoMTL in the caption.

These photo(s) :

- May be taken from outside or inside the house ;

- Must be taken after 18 May 2024, the day the house reopens ("old" photos of the house will not be taken into account);

- Must avoid showing works on loan to the museum (information appearing on the labels of the works), for reasons of reproduction rights;

- May freely represent works owned by the association (information appearing on the labels of the works).

In order for their entry to be taken into account, participants must ensure that their Instagram account is public for the duration of the Contest and that the publication containing the candidate photo (or photos) is (are) freely accessible on Instagram until 6 October 2024 inclusive. Any entry made contrary to the provisions of these rules will result in disqualification and the inability to win any prize awarded. Any participant suspected of fraud may be excluded from the Game by the SAMP without the SAMP having to justify this. More generally, any attempt to disrupt the normal process of running the Contest will result in the disqualification of the participant. Any identification or participation that is incomplete, erroneous or illegible, whether intentionally or not, or made in a form other than that provided for in these rules will be considered null and void.

  1. Designation of the winners - The first and second prizes will be chosen by a jury made up of SAMP directors and personalities invited by the jury chairman. The members' prize will be chosen by a vote of SAMP members.

The SAMP also takes the liberty of saluting some non-winning participants, hereinafter referred to as the "distinguished participants".

  1. Announcement of the winners - The winners and distinguished participants will be contacted via a message sent via the "Instagram Direct" messaging service, to which they will have to reply within 7 calendar days of receiving the message in order to accept their prize and distinction in writing. Winners and distinguished participants will then be asked to provide their title, first name, surname, age, postal address and e-mail address, as well as to send their winning or distinguished image in high resolution (minimum: 1 million pixels) to the address This email address is being protected from spambots. The SAMP shall not be liable in the event of incomplete data being supplied or in the event of the deletion or loss of emails or messages, or in the event of problems accessing social networks.

  2. Prizes - Three prizes will be awarded:

- 1st prize: €250
- 2nd prize: €150
- Members' prize: €200

Prizes are awarded in the form of cheques drawn up in euros, cashable in France. They cannot be claimed in any other form. The organisers reserve the right to change the nature and value of the prizes if necessary.

No change (of date, prize, etc.) for any reason whatsoever may be requested from the SAMP. It is specified that the SAMP will not provide any service or guarantee, the prize consisting solely of the payment of the cheques provided for above. Consequently, all general expenses relating in particular to travel costs to the Maison de tante Léonie, the price of the admission ticket to the museum, etc. will remain the responsibility of the winner. No reimbursement will be due in this respect.

  1. Liability - Participation in the Game implies knowledge and acceptance of the characteristics and limits of the Internet network, particularly with regard to technical performance, response times for consulting, querying or transferring information, the risks of interruption, the risks associated with the connection, the lack of protection of certain data against possible misappropriation and the risks of contamination by any viruses circulating on the network. The SAMP may not be held responsible, in particular, for malfunctions that may affect the Internet network, for any configuration problem or problem related to any browser whatsoever.

In this respect, participants undertake to comply with the laws in force.

The SAMP does not guarantee that Instagram will be accessible without interruption, that the site will function and that it will not contain computer errors or defects. The SAMP may not be held liable on this basis.

Neither shall SAMP be held liable for technical malfunctions of the Game, if participants are unable to connect to Instagram or to play, if the data relating to registration is not received for any reason not attributable to SAMP, arrives illegible or impossible to process or in the event of problems with the delivery of electronic mail. Participants may not claim any compensation in this respect.

Participation in the Game is the sole responsibility of the participants. The SAMP may not be held liable for any damage, whether material or immaterial, caused in particular to participants, their computer equipment and the data stored on it, or any direct or indirect consequences that may arise, in particular from their personal, professional or commercial activity.

The SAMP shall not incur any liability whatsoever if, in the event of force majeure, it is forced to cancel this Game, to shorten it, extend it, postpone it or modify its conditions. In all cases, it reserves the right to extend the participation period. These changes will however be the subject of prior information by all appropriate means.

The SAMP may not be held liable for delays, loss, theft or illegibility of postmarks due to the postal services. Neither shall it be held liable and no recourse may be taken against it in the event of the occurrence of events presenting the characteristics of force majeure (strikes, bad weather, etc.), fortuitous events or acts of a third party, depriving in particular participants from participating in the Contest and/or the winners from receiving their prizes.

  1. Participants' personal data - The personal data that the prize-winner provides about him/herself (first name, surname, age, postal address, e-mail address) is recorded in a computer file by the Société des amis de Marcel Proust et des amis de Combray.

The data will only be used and processed insofar as this is necessary to send the winners their prize at their personal address and to check that they have reached the age of majority.

Participants' personal information will be kept for a period not exceeding 5 years, unless:

- winners exercise their right to delete their personal data, under the conditions described below;
- a longer retention period is authorised or imposed by virtue of a legal or regulatory obligation.

During this period, SAMP shall put in place all appropriate means to ensure the confidentiality and security of participants' personal data, so as to prevent it from being damaged, deleted or accessed by unauthorised third parties. Access to participants' personal data is strictly limited to persons from the association in charge of organising the Instagram competition. SAMP undertakes not to sell, rent, transfer or give access to third parties to the personal data of prize-winners without their prior and explicit consent, unless compelled to do so for a legitimate reason (legal obligation, fight against fraud or abuse, exercise of rights of defence, etc.).

In accordance with the French Data Protection Act of 6 January 1978, as amended, and European Regulation no. 2016/679/EU of 27 April 2016 (applicable from 25 May 2018), prizewinners have the right to access, rectify, port and delete their data or limit the processing thereof. They may also, on legitimate grounds, object to the processing of data concerning them.

For any additional information or complaints, participants may contact the Commission Nationale de l'Informatique et des Libertés (more information at www.cnil.fr).

  1. Authorisations - Participants authorise SAMP to freely use the images entered in the competition, as well as their Instagram handle, for publication, reproduction and representation on all forms of written, electronic or audiovisual media, including but not limited to:

- on the www.amisdeproust.fr website;

- in the media (for example, to promote the results of the competition and any subsequent competitions);

- in the Bulletin Marcel Proust or in a volume published or co-edited by the Société des amis de Marcel Proust.

The winners and distinguished participants also extend these authorisations to their first and last names.

Under no circumstances may these uses give rise to remuneration or the payment of royalties.

  1. Compliance with the rules - Participation in this competition implies the full agreement of the participants to the acceptance of these rules and to the decisions taken by the SAMP on any aspect of this competition, which shall be final and binding. Failure to comply with the rules will result in cancellation of participation.

  2. Disputes and claims - The SAMP reserves the right to settle, without appeal, any difficulty that may arise as to the interpretation or application of these rules, it being understood that no dispute will be admitted, in particular as to the terms and conditions of the Contest, the results, the prizes or their receipt, one month after the end of the Contest. Any claim must be sent to SAMP within one month of the end of the Contest. After this date, no claims will be accepted. Except in the case of obvious errors, it is agreed that the information resulting from the SAMP's game systems has evidential value in any dispute as regards the connection elements and the computer processing of said information relating to the Game.

By express agreement between the participant and the SAMP, only the computer systems and files of the SAMP shall be deemed authentic. It is therefore agreed that, in the absence of manifest error, the SAMP may rely, in particular for the purposes of proof of any act, fact or omission, on programmes, data, files, recordings, operations and other elements (such as monitoring reports or other statements) of a computer or electronic nature or format or medium, drawn up, received or stored directly or indirectly by the SAMP.

  1. Applicable law - These rules are governed by French law. In the event of a persistent disagreement over the application of these rules, the dispute will be submitted to the sovereign judgement of the competent French courts.

  2. Limitation of link with Instagram - This competition is not sponsored, supported or managed by Instagram, nor is it associated with Instagram.
